1. Your agreement with us
These Terms of Service ("Terms") form a binding agreement between you and Bloom: Learn & Grow ("Bloom," "we," "us," or "our"), published by Spencer McIntosh, when you create a Bloom account, use the Bloom mobile app, or visit bloomlearnandgrow.com. By doing any of those things, you agree to these Terms and to our Privacy Policy.
If you don't agree, please don't use Bloom.
2. Who can use Bloom
To create a Bloom account, you must be at least 18 years old and either a parent or legal guardian of any child whose profile you set up under that account.
Children may use Bloom only through profiles set up and managed by their parent or guardian. Children do not have independent accounts on Bloom and cannot purchase subscriptions, change settings, or contact us directly.
3. Your account
You're responsible for keeping your login credentials confidential, and for any activity that happens under your account. If you believe your account has been accessed without your permission, contact us right away at support@bloomlearnandgrow.com.
You agree to give us accurate information when creating your account and to keep it current.
4. Subscriptions, billing & trials
Bloom is a subscription service. We offer two plans:
- Basic โ 1 child profile
- Family โ up to 4 child profiles
Each plan is available in monthly or annual billing. Current prices are shown on bloomlearnandgrow.com and inside the app at the time of purchase.
Free trial
New subscribers receive a 14-day free trial of the plan they select. You will not be charged during the trial. If you do not cancel before the trial ends, your subscription will automatically begin at the listed price.
Auto-renewal
All subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Renewal is charged through your Apple App Store account at the listed price.
Payment processing
All payments are processed by Apple through the App Store. We never see or store your payment information. Apple's terms govern the payment portion of your subscription. Tax may apply based on your billing location.
5. Cancellation & refunds
You can cancel your subscription at any time through your Apple App Store account: open Settings โ [your name] โ Subscriptions on your device.
When you cancel, you keep access until the end of your current billing period. We do not pro-rate or issue partial refunds for unused time.
Refund requests for any subscription purchased through the App Store are handled by Apple, not by us. To request a refund, visit reportaproblem.apple.com.
6. Your license to use Bloom
For as long as your account is active and in good standing, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Bloom app and curriculum content for the educational benefit of the children whose profiles you've set up under your account.
You don't get any other rights. In particular, you may not:
- Resell, sublicense, or commercially redistribute Bloom or any of its content.
- Use Bloom to provide tutoring, classroom instruction, or educational services to anyone outside your immediate family without our written permission.
- Copy, reproduce, modify, scrape, or create derivative works from the Bloom app or its curriculum.
- Reverse engineer or attempt to extract source code from the app.
7. Acceptable use
You agree not to:
- Use Bloom in any way that violates applicable law.
- Attempt to gain unauthorized access to other accounts or to our systems.
- Interfere with or disrupt the app's normal operation.
- Use automated tools (bots, scrapers, etc.) to access Bloom.
- Impersonate another person or misrepresent your relationship to a child whose profile you set up.
8. Our content & intellectual property
Bloom's name, logo, the Cornelius and Cordelia characters, the curriculum, the question banks, the artwork, the sound design, and all the code that powers the app โ all of it is owned by us or licensed to us. You don't acquire any ownership of any of it by using Bloom.
If you submit feedback, suggestions, or ideas to us, we're free to use them without obligation to you. (We promise not to claim you wrote them, though.)
9. Service availability & changes
We work hard to keep Bloom running smoothly, but we don't guarantee uninterrupted access. We may need to take the service offline for maintenance, updates, or unforeseen issues.
Bloom is an evolving product. We may add, modify, or remove features over time. We'll do our best to give advance notice of significant changes that materially affect your experience, and we won't make changes that materially reduce what you've already paid for during a current billing period without offering you a way out.
10. Disclaimers & limitations
Bloom is an educational supplement, not professional advice. We don't guarantee specific academic outcomes, test scores, IEP progress, or grade-level achievement. Every child learns differently. We've designed Bloom carefully and aligned it to recognized educational standards (Common Core, Science of Reading, Orton-Gillingham, AG Bell / AVI principles), but it is not a substitute for diagnosis or treatment by qualified professionals such as teachers, speech-language pathologists, audiologists, or learning specialists.
To the maximum extent permitted by law:
- Bloom is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, or data.
- Our total liability to you for any claim arising out of or relating to these Terms or your use of Bloom is limited to the amount you paid us in the 12 months immediately before the claim arose, or $50, whichever is greater.
Some jurisdictions don't allow some of these limitations, so they may not apply to you.
11. Termination
You can end your relationship with Bloom at any time by canceling your subscription and, if you wish, deleting your account by emailing us.
We can suspend or terminate your account if you violate these Terms, if your account is involved in fraudulent activity, or if we're legally required to. We'll give you reasonable notice when we can.
12. Disputes & governing law
If you have a problem, email support@bloomlearnandgrow.com first. We'll do our best to resolve it without lawyers.
If we can't resolve a dispute informally, these Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, and any legal action will be brought in the state or federal courts located in Duval County, Florida. You and we both consent to that jurisdiction.
Nothing in this section limits your right to file a complaint with a regulator or to pursue claims in small-claims court where applicable.
13. Changes to these terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top. For material changes, we'll give you advance notice by email or in-app notice. Your continued use after the effective date means you accept the updated Terms. If you don't accept them, please stop using Bloom and cancel your subscription.
